- Primero. REVOCAR la sentencia proferida por el Juzgado Dieciséis Civil del Circuito de Medellín, el 24 de Mayo de 2001. En su lugar, TUTELAR le derecho fundamental de petición de la señora Teresa de Jesús Franco Zuluaga.
- Segundo. ORDENAR a la Subdirección General de Prestaciones Económicas de la Caja Nacional de Previsión Social, con sede en Bogotá, que dentro del término perentorio de cuarenta y ocho (48) horas a partir de la notificación de esta providencia, resuelva, si aún no lo ha hecho, el recurso de apelación interpuesto por la señora Teresa de Jesús Franco Zuluaga contra la Resolución No. 026256 de noviembre 14 de 2000, el cual se encuentra a espera de turno de estudio en esa dependencia bajo la partida No. 2865 de 2000.
- Tercero. Por Secretaría General, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
