- Primero. Confirmar la decisión proferida por el Juzgado 4 Penal Municipal de Medellín, en cuanto negó los medicamentos solicitados al actor por no haber sido prescritos por un medico adscrito a Cruz Blanca EPS.
- Segundo. Ordenar a Cruz Blanca EPS que autorice el examen de carga viral y demás exámenes que el señor Marco Tulio Torres requiera en aras de garantizar el RDENAoo
- derecho a la salud en conexidad con la vida, pudiendo la accionada repetir contra el FOSYGA, el costo de los mismos.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
