- Primero. ESTARSE A LO RESUELTO en la sentencia C-734 de 2003 que declaró inexequibles los artículos 42, 43 y 44 del Decreto 1278 de 2002 y exequible el artículo 64 del mismo cuerpo normativo sólo por los cargos estudiados en aquella ocasión.
- Segundo. Declarar INEXEQUIBLES los artículos 41, 45 y 62 del Decreto 1278 de 2002.
- Tercero. Declarar EXEQUIBLE, únicamente por los cargos estudiados en esta oportunidad, el artículos 37 del Decreto 1278 de 2002.
