- Por exceder el marco fijado por el legislador ordinario en el artículo 1o. de la ley 30 de 1987, declaránse INEXEQUIBLES el literal c) del artículo 3o. del decreto 1888 de 1989, y el artículo 1o. del decreto 2281 de 1989 en la parte que textualmente reza:
- "c) Quienes se encuentren en detención preventiva por delito doloso aunque gocen del beneficio de excarcelación, o hayan sido afectados por resolución de acusación o su equivalente en proceso penal, por el mismo delito, mientras se define su responsabilidad".
