- Primero. Declarar INEXEQUIBLES el artículo 36, inciso tercero, de la Ley 35 de 1993 y el Decreto 0653 de 1993 en su totalidad.
- Segundo. Declarar EXEQUIBLES los numerales 2, 3, 5, 6, 7, 10 y 14 del artículo 9 de la Ley 32 de 1979, incorporados a la normatividad que estructura y organiza la Superintendencia de Valores por disposición expresa del artículo 1º del Decreto 2739 de 1991.
- Tercero. Declárase EXEQUIBLE el artículo 6º del Decreto 831 de 1980.
- Cuarto. La exequibilidad de las precedentes normas se declara en el entendido de que las disposiciones de carácter general que, en ejercicio de sus funciones, dicten la Sala General de la Superintendencia de Valores y el Superintendente de Valores están sujetas a las reglas generales de las leyes marco previstas en el artículo 150, numeral 19, literal d), de la Constitución Política y a los reglamentos de las mismas, dictados por el Gobierno Nacional en su desarrollo.
