- RESUELVE:
- Decláranse INEXEQUIBLES: el artículo 1852 del Código Civil, en la expresión "entre cónyuges no divorciados y"; el artículo 3º de la Ley 28 de 1932, en cuanto dispone que "son nulos absolutamente entre cónyuges ... los contratos relativos a inmuebles"; y el artículo 906, numeral 1º del Código de Comercio, en la expresión "los cónyuges no divorciados, ni", por las razones expuestas en la parte motiva de esta providencia.
