- Primero. REVOCAR el fallo de fecha veinte (20) de mayo de 2003, proferido por el Juzgado
- Primero. Laboral del Circuito de Cartagena que nego la tutela incoada, y en su lugar CONCEDER la proteccion del derecho de peticion de la senora Francia Elena de Avila Ramos.
- Segundo. ORDENAR a CAJANAL E.P.S., que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, si aun no lo ha hecho, profiera el acto administrativo tendiente a dar solucion de fondo a lo pedido por la senora Francia Elena de Avila Ramos, teniendo en cuenta las pruebas que aporte la accionante, y los requisitos que consagre la Ley 100 de 1993 y la Ley 797 de 2003.
- Tercero. Se previene a CAJANAL E.P.S., para que en el futuro no incurra en esta clase de omisiones, que como en el caso concreto ha dado como resultado la vulneracion de los derechos fundamentales de sus afiliados.
- Cuarto. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
