- RESUELVE
- Primero. Por las razones expuestas en la parte considerativa de esta providencia, declararse INHIBIDA para emitir un pronunciamiento de fondo respecto de la prescriptibilidad o imprescriptibilidad de la indemnizacion sustitutiva y, a su vez, sobre la expresion acusada: "La accion para el reconocimiento de una pension prescribe en cuatro (4) anos; la accion para el reconocimiento de las demas prestaciones y el derecho a cobrar cualquier subsidio o pension ya reconocidas prescribe en un (1) ano", prevista en el articulo 36 de la Ley 90 de 1946.
