Primero. REVOCAR, por las razones expuestas en la presente sentencia, el fallo dictado por Tribunal Superior de Bogotá. En su lugar, CONCEDER la protección al derecho fundamental de petición del señor ABSALÓN PALOMINO ARTEAGA para lo cual ORDENA a la Caja Nacional de Previsión Social CAJANAL que si no lo ha hecho aún, proceda dentro de las cuarenta y ocho horas siguientes a la notificación de esta sentencia, a proferir un acto administrativo que resuelva de fondo la petición elevada por el tutelante.
Segundo. Por Secretaría, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
