Primero. REVOCAR el fallo proferido por la Corte Suprema de Justicia y en su lugar CONCEDER, la protección de los derechos a la vida, el trabajo y la digna subsistencia del pensionado, cuyo mínimo vital está afectado.
Segundo. ORDENAR a Cajanal, Seccional Medellín, que si a la fecha de notificación de esta providencia, no ha dado cumplimiento a lo que se le ha ordenado en la sentencia proferida por el Juzgado
Quinto. Laboral del Circuito de Medellín, en lo referente a la inclusión en nómina del actor, lo haga en el término perentorio e improrrogable de cuarenta y ocho (48) horas, y pague las mesadas adeudadas al señor ANTONIO MARIA RIVERA so pena de incurrir en las sanciones que contempla el artículo 52 del Decreto 2591 de 1991.
Tercero. Remitir copias a la Procuraduría General de la Nación, para las investigaciones disciplinarias a que haya lugar.
Por Secretaria, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
