- R E SU E L V E :
- Primero. REVOCAR la sentencia proferida por el Tribunal Superior de Riohacha, Sala Penal el 2 de octubre de 1997, y en su lugar, tutelar los derechos a la vida y a la seguridad social de Pablo Fontalvo Pérez.
- Segundo. ORDENAR Arnolfo Rafael Zapata Bustamante que, si aún no lo han hecho, reanude el pago de las mesadas pensionales de Hidelfonso José Torres Gutiérrez en el termino máximo de 48 horas contados a partir de la notificación de la presente providencia, so pena de las sanciones previstas en el Decreto 2591 de 1991 para el desacato y acuerdo con lo expresado en la parte motiva de este fallo.
- Tercero. COMUNICAR la presente providencia al juzgador de primera instancia para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
