Primero. REVOCAR el fallo proferido por el Juzgado
Octavo. Penal Municipal de Cali el 26 de diciembre de 1997.En su lugar CONCÉDESE, como mecanismo transitorio, la protección de los derechos a la vida, el trabajo y la digna subsistencia del pensionado, cuyo mínimo vital está afectado.
Segundo. ORDENASE al I.S.S. para que, si a la fecha de notificación de esta providencia, no ha dado cumplimiento a lo que se le ha ordenado en las sentencias proferidas por el Juzgado
Quinto. Laboral del Circuito y el Tribunal Superior de Cali en lo referente al reconocimiento de la pensión del actor y su respectiva inclusión en nómina, lo haga en el término perentorio e improrrogable de cuarenta y ocho (48) horas so pena de incurrir en las sanciones que contempla el artículo 52 del Decreto 2591 de 1991.
Tercero. Se confía al Juzgado
Octavo. Penal Municipal de Cali la vigilancia y verificación del acatamiento de esta providencia y de la que mediante ella se adopta.
Cuarto. Dese cumplimiento al articulo 36 del decreto 2591 de 1991.
