- PRIMERO. Inaplícase por inconstitucional en el presente caso, de conformidad con el art. 4 de la Constitución Política, la circular No. 18 de fecha Marzo 6 de 1992 originaria de la Superintendencia Bancaria.
- Enviése copia de ésta Sentencia a dicha Superintendencia.
- SEGUNDO. Revocar la sentencia de fecha 18 de agosto de 1994 proferida por la Sala Penal del Tribunal Superior del Distrito Judicial de Cartagena, mediante la cual se negó la tutela impetrada por los señores Clemente Meneses López, Tiburcio Loret Negrete y Martín J. Esquivel Camargo y, en su lugar, concédese la tutela de sus derechos fundamentales a la seguridad social y al pago de los reajustes a sus pensiones de jubilación, decretadas por la Caja Nacional de Previsión Social y ordénase al Banco del Estado oficina principal La Matuna de la ciudad de Cartagena dar cumplimiento a las órdenes de embargo emanadas del Juzgado
- Segundo. Laboral del Circuito de Cartagena, emitidas dentro de los procesos adelantados por los señores Clemente Meneses López, Tiburcio Loret Negrete y Martín J. Esquivel Camargo.
- TERCERO. Líbrense las comunicaciones a que se refiere el artículo 36 del Decreto 2591 de 1991, para los fines allí previstos.
