- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E:
- PRIMERO. REVOCAR la sentencia del Juzgado Doce Civil del Circuito de Santafe de Bogota, del dia quince (15) de septiembre de mil novecientos noventa y tres (1993), mediante la cual se denego la accion de tutela promovida por el ciudadano Napoleon Santander Ramirez contra la Universidad Distrital "Francisco Jose de Caldas".
- SEGUNDO. CONCEDER la tutela del derecho a la seguridad social, en lo que atane al pago de las mesadas pensionales del senor Napoleon Santander Ramirez Gutierrez, en el sentido de conminar al senor Lombardo Rodriguez, rector de la Universidad Francisco Jose de Caldas, para que en lo sucesivo se abstenga en incurrir en omisiones como las que originaron la presente accion.
- TERCERO. ENVIAR copia de la presente sentencia al senor Personero Distrital, para que vigile su cumplimiento, en cuanto al pago de las mesadas pensionales a cargo de la Universidad Distrital "Francisco Jose de Caldas", y en favor del peticionario Napoleon Santander Ramirez Gutierrez.
- QUINTO. LIBRAR comunicacion al Juzgado Doce Civil del Circuito de Santafe de Bogota, a efectos de que notifique esta sentencia a las partes y adopte las decisiones necesarias para adecuar su fallo a lo aqui dispuesto.
