- R E S U E L V E :
- PRIMERO. REVOCAR el fallo proferido por el Juzgado
- Tercero. Civil del Circuito de Santa Marta, el 22de noviembre de 1994, y en su lugar conceder la tutela del derecho a la seguridad social del señor CARLOS BERMUDEZ CAÑIZARES.
- SEGUNDO. ORDENAR a la Caja de Previsión Social del Departamento del Magdalena, a través de su Gerente, a que dentro de los quince (15) días hábiles siguientes a la notificación de la presente providencia, proceda a cancelarle al señor CARLOS BERMUDEZ CAÑIZARES, las mesadas pensionales que se le adeudan, de conformidad con el certificado suscrito por la misma Caja el 9 de septiembre de 1994 (el cual obra en el expediente), siempre y cuando dicho pago no se hubiese efectuado con anterioridad a la notificación de esta providencia.
- TERCERO. Por la Secretaría General de la Corte Constitucional, líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
