Primero. Revocar la sentencia del 8 de octubre de la Sala de Casacion Penal de la Corte Suprema de Justicia y conceder la tutela de los derechos al debido proceso, a la verdad y a la justicia del demandante Javier Giraldo Moreno. En consecuencia, se revocan las decisiones del Fiscal General de la Nacion del 13 de agosto de 2002 y del 4 de octubre de 2002, mediante las cuales rechazo la constitucion de parte civil solicitada por el demandante.
Segundo. Ordenar al Fiscal General de la Nacion que, en el termino de 48 horas a partir de la notificacion de la presente sentencia, proceda a admitir la demanda de constitucion de parte civil, presentada por Javier Giraldo Moreno.
Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
