Primero. REVOCAR la sentencia del 31 de agosto de 2001, mediante la cual la Seccion Quinta de la Sala de lo Contencioso Administrativo del Consejo de Estado confirmo la decision del Tribunal Administrativo del Cesar, por cuanto la tutela contra sentencias judiciales o de caracter judicial si procede, cuando estas violen los derechos fundamentales de los asociados.
Segundo. CONFIRMAR, por las razones expuestas en la presente decision, la sentencia del 27 de junio de 2001 del Tribunal Administrativo del Cesar, que nego la tutela presentada por CARBOANDES, al no encontrarse que en la decision arbitral se hubiese incurrido en via de hecho por defecto factico.
Tercero. LIBRESE por la Secretaria, la comunicacion prevista el articulo 36 del Decreto 2591 de 1991.
