- Primero. REVOCAR el fallo proferido por la Corte Suprema de Justicia el once de diciembre de mil novecientos noventa y ocho. En su lugar CONCÉDESE, la protección de los derechos a la vida, el trabajo y la digna subsistencia de la pensionada, cuyo mínimo vital está afectado.
- Segundo. ORDENASE al I.S.S. para que, si a la fecha de notificación de esta providencia, no ha dado cumplimiento a lo que se le ha ordenado en las sentencias proferidas por el Juzgado
- Primero. Laboral del Circuito de Cali, el Tribunal Superior de Cali y la Corte Suprema de Justicia, en lo referente al reconocimiento de la pensión de la actora y su respectiva inclusión en nómina, lo haga en el término perentorio e improrrogable de cuarenta y ocho (48) horas, y pague las mesadas adeudadas a la señora Ana de Jesús Arrubla de Correa so pena de incurrir en las sanciones que contempla el artículo 52 del Decreto 2591 de 1991.
- Tercero. Se confía al Tribunal Superior del Distrito Judicial de Cali la vigilancia y verificación del acatamiento de esta providencia y de la que mediante ella se adopta.
- Cuarto. DÉSE cumplimiento al articulo 36 del decreto 2591 de 1991.
