  1. Primero. REVOCAR la sentencia de febrero 24 de 2000 proferida por el Juzgado Dieciocho Civil del Circuito de Bogota y en su lugar TUTELAR los derechos fundamentales a la salud y a una vida digna del senor Luis Alberto Alzate Cruz.
  2. Segundo. ORDENAR a CAFAM A.R.S. que en el termino de cuarenta y ocho (48) horas a partir de la notificacion de esta sentencia, informe al actor las posibilidades que para la atencion de su salud se derivan del regimen contemplado en el articulo 31 del Decreto 806 de 1998.
  3. Tercero. ORDENAR a la Secretaria Distrital de Salud de Bogota que en el termino de cuarenta y ocho (48) horas a partir de la notificacion de esta sentencia, informe a Luis Alberto Alzate Cruz , identificado con Cedula de Ciudadania No. 79.895.047 de Bogota y domiciliado en la Carrera 63B No. 62D - 35 Barrio Isla del Sol de la ciudad de Bogota, Telefono 7107942, que entidades publicas o privadas que tengan contrato con el Distrito estan en capacidad de ofrecer la atencion quirurgica requerida.
  4. Cuarto. ORDENAR a CAFAM A.R.S. que coordine con la entidad estatal que finalmente deba prestar el servicio, lo referente a la practica de la cirugia. Lo anterior debera hacerse sin dilaciones ni omisiones injustificadas, siempre que se cumplan los requisitos normativos vigentes y se observe el procedimiento establecido.
  5. Quinto. Librense por Secretaria, las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
