- Primero.
- Primero. REVOCAR la sentencia proferida por el 30 de abril de 2004 por el Juez
- Tercero. Civil del Circuito el Juzgado en el proceso de Edith Henríquez Yacomelo contra el Instituto de Seguros Sociales seccional Magdalena.
- Segundo. CONCEDER la tutela del derecho fundamental de petición a Edith Henríquez Yacomelo, y en consecuencia, ORDENAR al ISS seccional Magdalena que en el término de cuarenta y ocho (48) horas contado a partir de la notificación de la presente Sentencia, proceda a dar respuesta a la solicitud presentada por la Personería Distrital de Santa Marta ante dicha dependencia y notifique personalmente dicha respuesta a la Personería Distrital de Santa Marta o a la señora Edith Henríquez Yacomelo. En esta respuesta el ISS seccional Magdalena se abstendrá de negar el pago de la incapacidad laboral con el fundamento de que la cotizante se encuentra en mora.
