- Primero. REVOCAR la sentencia proferida dentro del asunto de la referencia por la Sala Penal del Tribunal Superior del Distrito Judicial de Medellín, el 10 de abril de 2003. En su lugar, CONCEDER la tutela de los derechos a la salud y a la vida del señor Manuel José Restrepo Botero, para lo cual se CONFIRMA la Sentencia proferida por el Juzgado
- Séptimo. Penal del Circuito de Medellín, el 6 de marzo de 2003, con la aclaración indicada en la parte motiva de esta providencia.
- Segundo. ORDENAR, como consecuencia de lo anterior, al Representante Legal de la A.R.S. CAPRECOM, o quien haga sus veces, que dentro del perentorio término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, autorice la práctica del examen de laboratorio que requiere el afiliado, siempre que el mismo no se haya realizado.
- Tercero. LÍBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí previstos.
