- Primero. LEVANTAR la suspensión del término decretada por éste despacho.
- Segundo. REVOCAR la sentencia adoptada por el Juzgado
- Sexto. Civil del Circuito de Bogotá el 18 de junio de 2002.
- Tercero. CONCEDER, en su lugar, la tutela de los derechos fundamentales a la salud, en conexidad con la vida digna y la integridad personal, a la accionante CECILIA NIEVES BOHORQUEZ, para lo cual se ORDENA al Representante Legal del INSTITUTO DEL SEGURO SOCIAL EPS, o a quien haga sus veces, que dentro del perentorio término de cuarenta y ocho (48) horas a partir de la notificación personal de esta providencia, si es que aún no lo ha hecho, autorice la práctica del procedimiento denominado "Implante de audífono con su intervención quirúrgica", que requiere la afiliada CECILIA NIEVES BOHORQUEZ.
- Cuarto. SEÑALAR expresamente que el INSTITUTO DEL SEGURO SOCIAL EPS podrá repetir contra el FOSYGA lo que desembolse por concepto de la orden dada en este fallo.
- Quinto. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
