- Primero. REVOCASE el fallo proferido por el Juzgado
- Primero. de Familia de Pereira el 25 de marzo de 2003, dentro del proceso de tutela instaurado por el senor Gilberto Hernandez Ramirez contra Cajanal Seccional Risaralda por las razones expuestas en la parte motiva de este fallo.
- Segundo. En consecuencia, CONCEDASE la proteccion del derecho a la salud conculcado y ORDENASE a Cajanal, si no lo hubiere hecho, que en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, contrate con una IPS para que se lleve a cabo la evaluacion por especialista requerida por el actor y que fue ordenada por el medico tratante.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
