En el presente caso se alega la vulneración de los derechos fundamentales al debido proceso y al buen nombre, así como de los principios de la buena fe y la confianza legítima de una sociedad anónima simplificada, en tanto se le desconoció su condición de contratista en un contrato de concesión y se surtió una actuación administrativa que dio lugar a la declaratoria de caducidad del contrato.
Luego de reiterar jurisprudencia relacionada con el principio de subsidiariedad de la acción de tutela y el control jurisdiccional de la actuación contractual del Estado, especialmente de la declaratoria de caducidad, la Sala de Revisión decide confirmar las decisiones de instancia que negaron por IMPROCEDENTE la tutela impetrada.
