- Primero. REVOCAR la sentencia proferida por el Juzgado
- Primero. Penal Municipal de Girardot -Cundinamarca-, el 7 de noviembre de 2002, mediante el cual no se tutelo los derechos a la igualdad y a la salud del menor Breidy Andres Diaz Rodriguez y en su lugar CONCEDER la tutela de los derechos a la vida digna, la salud y la seguridad social del mismo.
- Segundo. ORDENAR a SALUD ECOOPSOS A.R.S., con sede en Girardot - Cundinamarca -, que practique el examen de evaluacion especializada de la audicion del citado menor, ordenado por el medico tratante, con el fin de determinar la necesidad y la posibilidad medicas de realizarle un implante coclear, dentro de las dos (2) semanas siguientes a la notificacion del presente fallo.
- Tercero. Si conforme a la ley y a la reglamentacion correspondiente, es procedente la A.R.S. (Salud Ecoopsos A.R.S.), puede solicitar al Fondo de Solidaridad y Garantia del Sistema General de Seguridad Social en Salud (FOSYGA) el reembolso de los gastos en que incurra por la practica del examen indicado.
- Cuarto. Por Secretaria, librese la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991.
