- Primero. REVOCAR la Sentencia proferida por el Juez
- Tercero. Civil Municipal de Pasto el cinco (5) de febrero de 2001, en la que se decidió no tutelar los derechos invocados por el accionante.
- Segundo. CONCEDER la protección solicitada al derecho fundamental a la salud de los niños. En consecuencia, ORDENAR a la E.P.S. Salud Cóndor que en el término de cinco (5) días contados a partir de la notificación de la presente sentencia, adopte las decisiones necesarias para que se le practique el transplante de hígado que requiere la menor de edad Karen Xiomara Vallejo Arias en una institución prestadora del servicio de salud con capacidad técnica adecuada para realizarlo. La E.P.S. podrá repetir en contra del Fondo de Solidaridad y Garantía (FOSYGA) para que éste asuma los gastos en que se incurran para garantizar el tratamiento de Karen Xiomara Vallejo Arias, según lo determinen los médicos especialistas en la materia.
- Tercero. ORDENAR a la Secretaría de Salud de Pasto y a la Secretaría de Salud de Nariño que presten a la E.P.S., de manera prioritaria y oportuna, la colaboración administrativa que ésta solicite para cumplir lo ordenado en esta providencia.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
