- Primero. REVOCAR la sentencia proferida por el juzgado
- cuarto. civil del circuito de Ibagué. En su lugar CONCEDER la tutela del derecho a la salud en conexidad con la integridad personal.
- Segundo. INAPLICAR, con base en el artículo 4 de la Constitución Política, y para el caso concreto que fue objeto de examen por parte de esta Sala de Revisión, el artículo 18 de la Resolución 5261 de 1994 del Ministerio de Salud por la cual se establece el Manual de Intervenciones y Procedimientos del Plan Obligatorio de Salud.
- Tercero. ORDENAR a la Caja de Compensación Familiar Campesina- COMCAJA - y a la Secretaría de Salud del Tolima que tomen las medidas necesarias para que en el término de quince (15) días siguientes a la notificación de este fallo, realicen la operación que la actora requiere de conformidad con las prescripciones del médico tratante.
- Cuarto. Las entidades mencionadas podrán repetir los gastos en que incurran en cumplimiento de este fallo, contra el Fondo de Solidaridad y Garantía, Subcuenta de promoción a la salud.
- Quinto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
