- Primero. REVOCAR la sentencia proferida por el Juzgado
- Tercero. Civil de Familia de Montería el 27 de agosto de 2001. En su lugar, conceder la tutela interpuesta por la señora Erika Espitia Noble. En consecuencia, se ordena a SaludCoop E.P.S., que en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, suministre las bolsas de colostomía que sean necesarias para el tratamiento prescrito por el médico tratante.
- Segundo. SaludCoop E.P.S., deberá asumir los costos de los elementos referidos, y podrá repetir por los gastos en que incurra contra el Fondo de Solidaridad y Garantía, subcuenta de promoción de la salud.
- Tercero. INAPLICAR por inconstitucional para el caso concreto, el Acuerdo 5261 de 1994, artículo 18.
- Cuarto. Por Secretaría General líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
