- Primero. REVOCAR las sentencias proferidas por el Tribunal Superior del Distrito Judicial de Pasto, de fecha 11 de abril del 2000, que a su vez confirmó la proferida por el Juzgado
- Segundo. Civil del Circuito de Pasto, de 14 de Marzo del 2000, y en su lugar, conceder la tutela de los derechos a la seguridad social, al mínimo vital y a recibir una pensión, del actor HECTOR SILVIO ORTIZ ORDEÑO. En consecuencia el I.S.S. deberá corregir la Resolución No. 1219 del 10 de marzo de 1997 y expedir la que en derecho corresponda.
- Segundo. ORDENAR a la Caja Nacional de Previsión Social y al Departamento de Nariño, para que, en el término de 48 horas contadas a partir de la notificación de esta providencia, pongan a disposición del Instituto de los Seguros Sociales, Seccional Nariño, el dinero correspondiente al bono pensional necesario para que se surta el trámite y reconocimiento de la pensión de jubilación adelantada por el actor ante dicha entidad.
- Tercero. Líbrense por Secretaria, las comunicaciones a que se refiere el articulo 36 del decreto 2591 de 1991.
