- Primero. REVOCAR la sentencia del Juez
- Cuarto. Penal Municipal de Medellín y en su lugar conceder la tutela de los derechos a la salud en conexidad con la vida.
- Segundo. DECLARAR que la señora FLOR MARIA RAMÍREZ DE ACUÑA tiene derecho a que se le practique a la mayor brevedad posible la intervención quirúrgica, en los términos ordenados por su medico tratante.
- Tercero. ORDENAR a COMFAMA- Administradora del Régimen Subsidiado en Medellín, que en el término de cuarenta y ocho horas contadas a partir de la notificación de esta sentencia, autorice la práctica de la cirugía denominada histerectomía vaginal más plastias, recomendada por el médico que tiene a su cargo la salud de la accionante.
- Cuarto. Autorizar a COMFAMA para que efectúe ante el FOSYGA el recobro de los dineros invertidos en el procedimiento quirúrgico denominado "plastias".
- Quinto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
