- Primero. REVÓCASE la sentencia proferida por el Juzgado Promiscuo Municipal de Venecia -Antioquia-, el seis (6) de mayo de 2001, en la acción de tutela instaurada por Maria Doris Rodas Alzate, en representación de su hija, Leydy Johana, contra Caja de Compensación Familiar Comfenalco -Antioquia. A.R.S. En su lugar, CONCÉDASE el amparo solicitado.
- Segundo. En consecuencia, ORDÉNASE a la Caja de Compensación Familiar Comfenalco -Antioquia. A.R.S. que, a más tardar, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, autorice la práctica de la cirugía a la menor, en los términos expuestos en la parte motiva de este fallo, sin anteponer intereses de carácter legal.
- Tercero. Por Secretaría General, LÍBRENSE las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
