- Primero. CONFIRMAR los fallos proferidos dentro de los expedientes T-477637 y T-476930 por existir hecho superado.
- Segundo. CONFIRMAR la sentencia proferida por el Tribunal Superior de Bogotá dentro del expediente T-477599 en cuanto negó la tutela por el derecho a la salud y la vida del accionante. CONCEDER la tutela del derecho a la igualdad.
- En consecuencia, se ordena al Hospital accionado que en coordinación con la Secretaría de Salud de Bogotá, efectúe una nueva encuesta SISBEN, al señor Carlos Usma Lemus, y se le informe, si de acuerdo con el resultado obtenido, tiene derecho a beneficiarse del régimen subsidiado de salud.
- Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
