- Primero. REVOCAR la sentencia proferida por Juzgado Treinta y Cinco Penal Municipal de Bogotá, que negó el amparo solicitado por Javier Pulido Galindo. En consecuencia, conceder la tutela por los derechos a la salud en conexidad con la vida.
- Segundo. ORDENAR a COMFENALCO A.R.S. que continúe asumiendo el costo total del tratamiento a que está siendo sometido el señor Javier Rogelio Pulido Galindo y cuando el médico tratante así lo determine autorice el transplante alogénico de médula ósea que se ordene y si es necesario, realice las diligencias para suscribir un contrato para un solo paciente con el Instituto Nacional de Cancerología, con el fin de garantizar la continuidad en el tratamiento que se viene siguiendo al peticionario, pudiendo para todo ello, repetir contra el Fosyga por los gastos en los que incurra.
- Tercero. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
