- Primero. REVOCAR el fallo de noviembre nueve (9) de dos mil (2000), proferido por el Juzgado
- Cuarto. Penal Municipal de Medellín, que negó la protección solicitada. En su lugar CONCEDER la tutela de los derechos a una vida digna, a la integridad personal, a la salud y a la seguridad social de la señora Rosalba Stella Henao Gaviria.
- Segundo. ORDENAR a SaludCoop E.P.S que en el término de quince (15) días, contados a partir de la notificación de esta sentencia, autorice y programe la cirugía que requiere Rosalba Stella Henao Gaviria.
- Tercero. INAPLICAR Por ser contrarios a la Constitución Política, en este caso, el artículo 28 del Decreto 806 de 1998 y la Resolución No. 5261 de 1994 que excluyeron del POS la cirugía requerida.
- Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
