- PRIMERO. REVOCAR el fallo de julio treinta y uno (31) del año dos mil tres (2003), proferido por el Juzgado
- Primero. Laboral del Circuito de Palmira - Valle y en su lugar, TUTELAR el derecho de petición solicitado por el señor MARIO TONGUINO SUÁREZ.
- SEGUNDO. ORDENAR al INSTITUTO DE SEGUROS SOCIALES Seccional Valle del Cauca, que si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia profiera el acto administrativo correspondiente que resuelva de fondo lo solicitado por el señor MARIO TONGUINO SUÁREZ.
- TERCERO. PREVENIR al INSTITUTO DE SEGURO SOCIAL para que en el futuro se abstenga de incurrir en esta clase de actuaciones que como en el caso concreto vulnera los derechos fundamentales de sus afiliados.
- CUARTO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
