Demanda de inconstitucionalidad contra el inciso 2 (parcial) del artículo 657 del Decreto 624 de 1989 “por el cual se expide el Estatuto Tributario de los impuestos administrados por la Dirección General de Impuestos Nacionales.

Los demandantes solicitan que el aparte acusado sea declarado inexequible, alegando que vulnera el derecho a la igualdad consagrado en el Preámbulo y el artículo 13 de la Constitución Política.

La Corte encontró que demanda no cumplía con los requisitos de claridad, certeza especificidad, pertinencia y conducencia para poder emitir un pronunciamiento de fondo y, en tal sentido, se declara INHIBIDA por ineptitud sustantiva de la demanda, respecto de la expresión “por evasión” contenida en el articulo impugnado.
