- Primero. Sobre los artículos 68 y 82 de la ley 446 de 1998, estarse a lo resuelto en la sentencia C-160 de 1999, que los declaró inexequibles.
- Segundo. Declárase EXEQUIBLE el artículo 167 de la ley 446 de 1998, en la parte demandada, en cuanto deroga el artículo 46 de la ley 23 de 1991.
- Tercero. Declárase EXEQUIBLE el artículo 88 de la ley 446 de 1998, bajo las condiciones expuestas en la parte considerativa de esta sentencia.
- Cuarto. Decláranse EXEQUIBLES los artículos 149, 150, 151, excepto los numerales 4 y 5, numerales que se declaran INEXEQUIBLES, 152, 153, 154, 155, 156, 157, 158, 159, 160 y 161 de la ley 446 de 1998.
