Demanda de inconstitucionalidad contra el artículo 9º de la Ley 938 de 2004, por la cual se expide el Estatuto Orgánico de la Fiscalía General de la Nación.
El demandante considera que la expresión “institucional” contenida en el artículo 9º de la Ley 938/04 reproduce el contenido normativo declarado inexequible por la Corte Constitucional.
La Sala Plena de la Corporación concluye que frente al caso concreto se está ante el fenómeno de la cosa juzgada material en relación con lo decidido por la sentencia C-037/96, ello, debido a que la norma acusada reproduce un contenido normativo declarado inexequible por la Corte por razones de fondo, sin que se haya modificado el parámetro de control de constitucionalidad.
En consecuencia, se decide ESTARSE A LO RESUELTO en la sentencia C-037/96 y por tanto, declarar INEXEQUIBLE la expresión “institucional” demandada.
