- segundo. de la sentencia de la Sala Civil Familia Laboral del Tribunal Superior del Distrito Judicial de Neiva del 18 de junio de 2002 en la acción de tutela interpuesta por el señor Constantino Núñez contra la E.P.S. Cajanal.
- Segundo. ADICIONAR el mencionado fallo, ORDENANDO al Representante Legal de la E.P.S. CAJANAL, Seccional Neiva, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia asuma los tratamientos de quimioterapia y radioterapia que deben prestarse al accionante de conformidad con las prescripciones médicas, utilizando para ello la reserva presupuestal que respalda el monto contratado con la Liga de Lucha contra el Cáncer en la ciudad de Neiva. En el evento de que dicha reserva presupuestal se agote y cesen los efectos del contrato con la Liga, CAJANAL debe asegurarse que mediante la orden judicial emitida en esta tutela, los servicios continúen prestándose al demandante por la Liga de Lucha contra el Cáncer Neiva, haciendo las respectivas reservas presupuestales y las consiguientes garantías de pago de los servicios prestados.
- Tercero. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
