- Primero. REVOCAR el fallo proferido por el Juzgado
- Quinto. Civil Municipal de Neiva, dentro del proceso de la referencia.
- Segundo. ORDENAR a Cafesalud que, en el término de cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, proceda a reconocer y pagar la licencia de maternidad a la tiene derecho la señora Diana Castro Olaya a efectos de hacer efectiva la especial protección que la Constitución prescribe para las mujeres en las condiciones en que se encuentran ésta y su hijo recién nacido.
- Tercera: Por Secretaría General, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
