- Primero. REVOCAR la sentencia proferida por la Sala Civil del Tribunal Superior del Distrito Judicial de Pereira y, en su lugar, CONCEDER la tutela del derecho a la salud en conexidad con la vida de la señora MARÍA RUBIELA PELÁEZ CALLE.
- Segundo. ORDENAR al Instituto de Seguros Sociales, Seccional Risaralda que autorice en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia, las terapias fotodinámicas recomendadas por los médicos tratantes a la señora MARÍA RUBIELA PELÁEZ CALLE, aún cuando no se encuentren en el listado del P.O.S.
- Tercero. El Instituto de Seguros Sociales Seccional Risaralda, podrá repetir los gastos en que incurra en cumplimiento de este fallo, contra el Fondo de Solidaridad y Garantía, subcuenta de promoción a la salud.
- Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
