- Primero. REVOCAR la sentencia proferida por el Juzgado
- Séptimo. Penal Municipal de Medellín. En su lugar, TUTELAR los derechos fundamentales a la salud y la vida del joven JOHAN SEBASTIÁN VELÁSQUEZ RAMÍREZ,
- Segundo. ORDENAR a la E.P.S. del Seguro Social, Seccional Medellín, que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente decisión, proceda, si aún no lo ha hecho, a autorizar al joven Johan Sebastián Velásquez la entrega de las tirillas de medición de glucemia que requiere, todas las veces y por el tiempo que el médico tratante así lo ordene. Igualmente deberá en el mismo término, asegurarse de que los medicamentos denominados INSULINA ZINC CRISTALINA 100 U. I. y la NPH de 100 U.I. sean entregados al interesado por el tiempo y en la cantidad que el médico tratante así lo indique.
- Tercero. La E.P.S. del Seguro Social podrá repetir contra el Fosyga por los gastos en los que incurra en cumplimiento de este fallo.
- Cuarto. Por Secretaría General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
