- Primero. REVOCAR la sentencia proferida por el Juzgado
- Quinto. Civil del Circuito de Bogotá dentro de la acción de tutela instaurada por JORGE ORLANDO DELGAGO DELGADO. En su lugar, CONCEDER el amparo solicitado.
- Segundo. ORDENAR a la E.P.S. SALUDCOOP, que dentro de las cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, realice al señor JORGE ORLANDO DELGADO DELGADO, la prueba diagnóstica requerida en esta tutela, en la forma prescrita por el médico tratante.
- Tercero. Señalar que la EPS SALUDCOOP- le asiste el derecho de reclamar al FOSYGA los gastos asumidos en la realización de la prueba prescrita.
- Cuarto. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
