- Primero. REVOCAR la sentencia proferida por la Corte Suprema de Justicia, para en su lugar CONCEDER la tutela del derecho a la salud en conexidad con la vida del accionante Orlando Viloria Pernett.
- Segundo. INAPLICAR, con base en el artículo 4 de la Constitución Política y para el caso concreto que fue objeto de examen por esta Sala de Revisión, el parágrafo del artículo 28 del decreto 806 de 1998.
- Tercero. ORDENAR al representante legal o a quien haga sus veces, de la E.P.S. UNIMEC S.A. con sede en Barranquilla, que dentro del perentorio término de cuarenta y ocho horas (48) horas a partir de la notificación de la presente sentencia, autorice la práctica de la prueba de laboratorio denominada carga viral dispuesta por el médico tratante del señor Orlando Viloria Pernett.
- Cuarto. SEÑALAR expresamente que a la E.P.S. UNIMEC S.A. le asiste el derecho de repetir lo que pague en cumplimiento de este fallo de tutela ante la Subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (FOSYGA).
- Quinto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
