- Primero. REVOCAR el fallo proferido por el Juzgado
- Sexto. Penal del Circuito de Ibagué el 22 de julio de 2003, dentro del proceso de la acción de tutela instaurada por María Hermita Méndez Serrano en representación de su hija, y en su lugar CONCEDER la protección de los derechos fundamentales a la salud y a la vida de Jazmín Méndez Méndez.
- Segundo. ORDENAR a la A.R.S. CAFESALUD, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente sentencia proceda a practicar a Jazmín Méndez Méndez, el examen diagnóstico denominado "resonancia magnética de encéfalo con medio de contraste (gadolinio)" ordenado por su médico tratante.
- Tercero. ADVERTIR a CAFESALUD A.R.S., que podrá repetir contra el Estado específicamente contra Fondo de Solidaridad y Garantía (FOSYGA) en todos los gastos en los que incurra en cumplimiento de lo ordenado en este fallo y que no esté cubierto por el P.O.S-S
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
