- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Quinto. Civil del Circuito de Cartagena, el seis (6) de noviembre de 2002, y en su lugar CONCEDER la tutela del derecho a la salud en conexidad con el derecho a la vida de XXX.
- SEGUNDO. INAPLICAR para el caso concreto del señor XXX la Resolución 5261 de 1994 del Ministerio de Salud por la cual se establece el Manual de Intervenciones y Procedimientos del Plan Obligatorio de Salud por no incluir la prueba de carga viral dentro de las cubiertas por este, aplicar la Constitución Política y, en consecuencia, ORDENAR al Instituto de los Seguros Sociales que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia realice a XXX los exámenes denominados de Carga Viral y CD3-CD4-CD8, ordenados por el médico tratante.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
