- PRIMERO. REVOCAR la sentencia de tutela proferida por el Juzgado
- Segundo. Laboral del Circuito de Cali el 21 de abril de 2004, mediante la cual se negó la tutela a la señora Aída Ruby Mendoza de Libreros.
- SEGUNDO. En su lugar, CONCEDER el amparo de los derechos fundamentales a la salud en conexidad con el derecho a la vida de Aída Ruby Mendoza de Libreros y, en consecuencia, ORDENAR al Instituto de Seguros Sociales, Seccional Valle que, dentro de las cuarenta y ocho horas (48) siguientes a la notificación del fallo de revisión, le realice el examen de Resonancia Magnética Oculta ordenado por el médico tratante.
- TERCERO. Señalar que el Instituto de Seguros Sociales, Seccional Valle podrá repetir en contra del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud por el valor de la realización del examen Resonancia Magnética Oculta y el tratamiento que se requiera para el restablecimiento de la salud accionante en cumplimiento de esta sentencia.
- CUARTO. INAPLICAR con base en el artículo 4º de la Constitución Política y para el caso concreto de la señora Aída Ruby Mendoza de Libreros, la norma reglamentaria del Plan Obligatorio de Salud Subsidiado, en particular los Acuerdos 72 y 74 de CNSSS, toda vez que éstos no incluyen el examen ordenado.
- QUINTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
