- Primero. REVOCAR la sentencia de 8 de marzo de 2001 adoptada por el Juzgado
- Noveno. Civil del Circuito de Medellín, para en su lugar CONCEDER la tutela del derecho a la salud en conexidad con el de la vida al accionante BALMER ARBELÁEZ PIEDRAHITA.
- Segundo. ORDENAR, en consecuencia, al representante legal, o a quien haga sus veces, de la "Compañía Suramericana de Salud S.A. Susalud Medicina Prepagada S.A. EPS" con sede en Medellín, que dentro del perentorio término de cuarenta y ocho (48) horas a partir de la notificación de la presente sentencia, autorice la prueba de laboratorio denominada "carga viral" dispuesta por su médico tratante al accionante BALMER ARBELÁEZ PIEDRAHITA.
- Tercero. SEÑALAR expresamente que a "SUSALUD MEDICINA PREPAGADA S. A. EPS" le asiste el derecho de repetir lo que pague en cumplimiento de este fallo de tutela ante la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (FOSYGA).
- Cuarto. ORDENAR que por la Secretaria General de la Corporación, se libren las comunicaciones previstas por el artículo 36 del decreto 2591 de 1991.
