- Primero. REVOCAR el fallo proferido el veinte (20) de abril de dos mil uno (2001), por el Juzgado 10 Laboral del Circuito de Bogota, dentro de la accion de tutela instaurada por el senor Helber Mauricio Higuera Roa en representacion de su hijo Felipe Higuera Tovar contra la E.P.S. Salud Colmena Seccional Bogota, por las razones expuestas en la parte motiva de este fallo. En consecuencia, se CONCEDE el amparo solicitado por el actor, en los terminos de esta sentencia.
- Segundo. ORDENAR a la empresa promotora de salud, Salud Colmena de esta ciudad que, dentro del termino de cuarenta y ocho (48) horas, siguientes a la notificacion de esta sentencia, se autorice el suministro al menor Felipe Higuera Tovar de la ampolla TOXIMA BOTULINICA.
- Tercero. SENALAR que Salud Colmena E.P.S., podra repetir lo pagado en cumplimiento de la orden contenida en el numeral anterior, en contra de la subcuenta respectiva del Fondo de Solidaridad y Garantia del Sistema de Seguridad Social Integral en Salud FOSYGA.
- Cuarto. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
