- Primero. REVOCAR el fallo proferido por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Civil y, en su lugar, TUTELAR los derechos a la vida, a la salud y los de los niños, al menor JUAN SEBASTIAN OSPINA VELASQUEZ.
- Segundo. ORDENAR que se inaplique, por resultar inconstitucional para este caso, el artículo 61 del Decreto 806 de 1998, y en consecuencia, ORDENAR a la EPS CRUZ BLANCA, que en forma inmediata practique al menor JUAN SEBASTIAN OSPINA VELASQUEZ las intervenciones quirúrgicas necesarias, y le depare los tratamientos indispensables a juicio de los médicos de la institución.
- Tercero. La EPS CRUZ BLANCA podrá repetir lo que desembolse por concepto de este fallo, en contra de la Subcuenta de Enfermedades Catastróficas o Ruinosas del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud.
- Cuarto. Se CONFIRMA el fallo proferido por el Tribunal Superior del Distrito Judicial, respecto de la Secretaría de Salud del Distrito Capital.
- Quinto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
